Like the National Chambers, the territorial jurisdiction chamber of Bechar (T.C of Bechar ) was established by Ordinance 95-20 of 19 July 1995 related to the Court of Auditors, amended and supplemented ,by the Ordinance of 10-02 of 16 August 2010 (Articles 29 and 31), and provided by\u00a0 Article 09 of Presidential Decree n\u00b0 95-377 laying down \u00a0the rules of procedure of the Court of Auditors which specifies the jurisdiction and the territorial coverage of each chamber. Established on October 14th<\/sup>, 1998, its headquarters is located in the chief town of wilaya.<\/span><\/p>\n

The Territorial Chamber of Bechar is charged in accordance with Article 31 of Ordinance 95-20 of 17 July 1995, supplemented and amended, of a posteriori control of the finances, of the territorial authorities of all the public institutions and bodies under its territorial jurisdiction.<\/span><\/p>\n

At organizational level, the chamber is divided into section accordance with the order of 16 January 1996 the President of the Court of Auditors, specifying the areas of intervention of Territorial Chambers and determining their subdivision into section.<\/span><\/p>\n

In addition to the prerogatives of the President of the Chamber and the Section President who plans, animates, follows, coordinates, supervises and controls the activities of judges, the latter to the number of nine (09) have for main missions, the execution of the programs of activity of control of the Territorial Chamber.<\/span><\/p>\n

It also includes a support structure responsible for administrative and financial management, consisting of ten (10) administrative officers; this support structure is managed by a deputy director, bringing the total number of the staff to twenty one 20 (11 judges, 10 officers).<\/span><\/p>\n

The jurisdictions of the chamber extend over (04) wilayas and seventy-three municipalities divided as follows:<\/span><\/p>\n

\u00a0– Bechar: twenty-one (21) municipalities;<\/span><\/p>\n

– El Bayadh: twenty-two (22) municipalities;<\/span><\/p>\n

– Tindouf: two (02) municipalities;<\/span><\/p>\n

– Adrar: twenty eight (28) municipalities.<\/span><\/p>\n

The chamber includes a portfolio of 150 accounts, including 77 administrative accounts and 73 management accounts.<\/span><\/p>\n

In addition to the local authorities, the jurisdiction of the chamber also extends to local institutions and public bodies receiving full and partial financial support covered by its jurisdiction.<\/span><\/p>\n

As part of its duties, and like the eight (08) chambers of the Court of Auditors, the chamber carries out two main objectives namely:<\/span><\/p>\n

– It ensures judicial review of local authority management accounts. This control is to ensure the accuracy and consistency of the accounts produced by public accountants of local authorities or public institution within its jurisdiction, and that, during the clearance of these accounts in accordance with the rules of public accounting.<\/span><\/p>\n

This type of control may lead, where appropriate, to the personal and financial liability of public accountants, under the conditions set out in Articles 75 and following of Ordinance n\u00b095-20 of 17 July 1995, amended and supplemented.<\/span><\/p>\n

If during the investigations, the Chamber raises facts that may be characterized as criminal offenses or facts constituting a serious breach of the legislative provisions and regulatory provisions causing harm to the public treasury or a public body, depending on the situation, a detailed report is drawn up for its transmission to the territorially competent public prosecutor in the case of facts relating to the criminal case or referred to the Budget and Finance Disciplinary chamber (CDBF) in the field of its competence, and through the exercise of its attributions, the chamber also contributes to strengthening the prevention of the fight against various forms of fraud, and illegal or unlawful practices constituting breaches of ethics and the duty of probity or effecting patrimony or public funds according to the rules of articles 2 and 26 from the previous ordinance modified and supplemented by the ordinance n\u00b010- 02 of 26 august 2010.<\/span><\/p>\n

In addition, to promote transparency in the management of local finances and to improve the effectiveness and performance of the local public service, the results of the control carried out by the chamber, and notified to the concerned responsible must be communicated by these latter to the deliberative bodies of the local authorities, which shall inform the court of accounts of this communication.<\/span><\/p>\n

the territorial chamber of Bechar has a staff of control and administrative staff composed as follow:<\/span><\/p>\n

3- Attributions field of the territorial chamber of Bechar<\/strong><\/span><\/p>\n

The entities within the scope of the chamber are divided as follows:<\/span><\/p>\n

– Province of Bechar and its 21 municipalities<\/span><\/p>\n

– Province of Adrar and its 28 municipalities<\/span><\/p>\n

– Province of El Bayadh and its 22 municipalities<\/span><\/p>\n

– Province of Tindouf and its 2 municipalities<\/span><\/p>\n

The territorial chamber of Bechar has a necessary means allowing the magistrates of the structure a better support of the mission of control. These means can be summarized in the access to the internet of high flow, connection to the internal network, personal computer for each magistrate containing software allowing the consultation of the various laws and regulation relating to the court of accounts, public accountancy, public procurement, guides and manuals of control.<\/span><\/p>\n

It should also noted that in the current case of workforce, and considering the reception of new headquarters, the chamber has assigned office to each magistrate equipped by all necessary means.<\/span><\/p>\n
